Terms of Service

"Vilix", "we", "us" refers to Appfairly LLC, the operator of getvilix.com. Reach us at hello@getvilix.com.

• You must be at least 16 years old to use Vilix.
• Provide accurate account information and keep it current. You're responsible for everything that happens under your account, including any API tokens you generate.
• Keep your sign-in credentials and API tokens private. Tell us at support@getvilix.com promptly if you suspect unauthorized access. For active security incidents or suspected vulnerabilities, write to security@getvilix.com.
• One account per person. You may not transfer your account without our written permission.

Vilix is a memory layer for the AI tools you use. The Service saves your AI conversations, organizes them by platform and time, and lets you (and the AI tools you connect) search and retrieve them. Vilix does not run its own chatbot — connected tools continue to operate under their own terms.

"Your Content" means the conversations, memories, files, and other data you submit to, import into, or capture through the Service.

• You own Your Content. Nothing in these Terms transfers ownership of Your Content to us.
• License to operate the Service. You grant Vilix a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display Your Content solely as needed to provide the Service for you and to comply with the law. This license ends when you delete Your Content or close your account, except for backups, which expire on the schedule in our Privacy Policy.
• No model training on Your Content. We do not train, fine-tune, or sell foundation models on Your Content.
• You're responsible for what you put in. You represent that you have the rights necessary to import or capture each piece of Your Content, and that doing so does not violate the law, a third party's rights, or the terms of the source platform.

• Connectors are opt-in. Optional connectors (such as Gmail, GitHub, Discord) work over OAuth using the access scopes you approve. You can revoke them at any time.
• Browser extensions. Vilix browser extensions activate only on the AI domains you've enabled. You're responsible for ensuring that capturing and storing those conversations is permitted by the source platform and applicable law.
• API tokens. Tokens you generate in the dashboard grant the holder access to your account through the Vilix API. Treat them like passwords. You're responsible for actions taken with a token until you revoke it.
• Third parties. Connected AI tools and third-party services have their own terms and privacy practices. Vilix is not responsible for their behavior, availability, or how they handle data you share with them through the Service.

You may not, and may not allow anyone else to:

• Use the Service for anything illegal, abusive, fraudulent, or infringing.
• Upload or store content you don't have the right to use, including content that violates a non-disclosure agreement, employer policy, or third-party platform's terms.
• Upload content that is defamatory, harassing, or that depicts the sexual abuse or exploitation of minors.
• Use the Service to build, train, fine-tune, or evaluate a competing memory or search product, or to scrape Vilix or its connected platforms for that purpose.
• Reverse engineer, decompile, or attempt to extract source code from the Service, except where applicable law forbids restricting that activity.
• Probe, scan, overload, or interfere with the Service or its infrastructure, including bypassing rate limits, account isolation, or security controls.
• Resell, sublicense, or provide the Service to third parties as a hosted offering without a written agreement with us.
• Use the Service to send unsolicited messages, run phishing operations, or distribute malware.
• Misrepresent your identity, impersonate another person, or falsely claim affiliation with Vilix.

We may suspend or terminate accounts that violate these rules, with or without notice where appropriate.

New accounts get a 3-day free trial of Vilix. The trial does not require a payment method. After the trial, continued access requires a paid subscription; pricing and plans are shown inside the app before you confirm any charge.

We may change pricing, plan features, or trial length at any time. Changes do not apply retroactively to active paid subscriptions for the current billing period.

Vilix is still maturing. The Service is provided as-is. Features may change, appear, or disappear without notice. Availability, performance, and accuracy may vary. Don't rely on the Service for decisions where downtime or error would cause you harm.

Our Privacy Policy explains what we collect, how we use it, and the controls you have. By using the Service you agree to that policy.

The Service, including its software, design, branding, and documentation, is owned by Vilix or our licensors and is protected by intellectual property law. We grant you a limited, revocable, non-transferable, non-exclusive license to use the Service in accordance with these Terms. We reserve all rights not expressly granted.

Feedback, suggestions, or ideas you send us are not confidential, and we may use them without restriction or compensation.

• By you. You can stop using the Service and delete your account at any time from the dashboard.
• By us. We may suspend or terminate your account if you violate these Terms, if your use of the Service exposes us or others to legal or security risk, if required by law, or if we discontinue the Service.
• After termination. We stop providing the Service to you and delete or de-identify Your Content according to our Privacy Policy, except where retention is required by law.
• Survival. Sections covering ownership, license to feedback, disclaimers, limitation of liability, indemnity, and dispute resolution survive termination.

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising out of course of dealing or usage of trade.

Vilix does not guarantee that retrieval will surface every relevant memory, that connected AI tools will produce accurate output, or that the Service will be uninterrupted, error-free, or perfectly secure. Verify any output before relying on it for important decisions.

To the maximum extent permitted by law, Vilix and its affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or relating to the Service or these Terms.

Our total liability for any claim arising out of or relating to the Service or these Terms is limited to the greater of (a) the amount you paid Vilix for the Service in the twelve months before the event giving rise to the claim, or (b) one hundred US dollars (US$100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

You agree to defend, indemnify, and hold harmless Vilix and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from (a) Your Content, (b) your use of the Service, or (c) your violation of these Terms or applicable law.

We may change the Service over time — adding features, changing how features work, or retiring features. We may also update these Terms. When we make material changes to these Terms, we'll update the "Last updated" date and, where appropriate, notify you by email or in-app notice before they take effect. Continuing to use the Service after the effective date means you accept the new Terms.

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. The courts located in the State of Delaware, United States have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you and Vilix consent to that jurisdiction. If you are a consumer in a jurisdiction whose local law gives you the right to bring a claim in your local courts, this section does not take away that right.

• Entire agreement. These Terms and the documents they reference (including our Privacy Policy) are the whole agreement between you and Vilix about the Service.
• Severability. If any provision is held unenforceable, the rest stay in effect.
• No waiver. Our not enforcing a provision is not a waiver of it.
• Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
• Force majeure. Neither party is liable for delays or failures caused by events beyond reasonable control.
• Electronic communications. You agree that we may send you notices and disclosures electronically (email, in-app messages).
